비대면·온라인 강의에 따른 저작권 관련 유의사항 안내
1. 배경
연세대학교는 2020년 3월 28일까지(상황에 따라 추후 연장될 수 있음) 대면 강의를 중단하고, 한시적으로 모든 강의를 비대면·온라인 방식으로 시행합니다. 교강사가 온라인 강의에서 사용하는 ppt, 동영상 등 각종 자료는 교강사의 저작물이거나 타인의 저작물로서 저작권법으로 보호됩니다. 따라서 저작권법에 위반하여 강의자료를 사용할 경우 민·형사상 책임을 질 수 있으니 다음 사항에 유의하시기 바랍니다.
2. 유의사항
가. 허용되는 행위
학생들은 수업목적상 필요하다고 인정되는 경우에는 공표된 저작물의 일부분을 복제하거나 전송할 수 있습니다(저작권법 제25조제3항). 따라서 비대면·온라인 강의가 이루어지는 제한된 기간 동안 수업을 위해 강의자료를 복제(다운로딩)하여 학습목적으로 사용하는 행위는 허용됩니다.
나. 금지되는 행위
(1) 위와 같이 내려 받은 강의자료를 수강생 본인 외 제3자에게 배포(출력물의 경우), 전송(파일 업로드)하는 행위
(2) 강의자료를 수강생 외에는 (i) 이용할 수 없도록 하는 접근제한조치, (ii) 복제할 수 없도록 하는 복제방지조치를 무력화하는 행위. 예컨대 강의자료가 게시된 와이섹 등에 접근할 수 있는 아이디와 비밀번호를 타인과 공유하거나 알려주는 행위, 강의자료에 부착된 복제방지조치를 무력화하는 해킹 행위 등
(3) 특히 동영상을 포함하여 강의자료를 인터넷에 게시 또는 타인에게 전송하는 순간, 외국의 저작권 침해가 될 수 있고, 심각한 소송의 대상이 될 수 있습니다. 해당 강의자료에 외국의 저작물이 포함되어 있을 수 있고, 그것이 외국에서 접근가능한 상태가 되기 때문입니다. 따라서, 강의자료를 타인과 공유하거나 전송 및 공개하는 행위를 하여서는 안 됩니다.
저작권법
제136조(벌칙) ① 다음 각 호의 어느 하나에 해당하는 자는 5년 이하의 징역 또는 5천만원 이하의 벌금에 처하거나 이를 병과할 수 있다.
1. 저작재산권, 그 밖에 이 법에 따라 보호되는 재산적 권리(제93조에 따른 권리는 제외한다)를 복제, 공연, 공중송신, 전시, 배포, 대여, 2차적저작물 작성의 방법으로 침해한 자
Copyright Issues concerning Online/Non-Face-to-Face Lectures
1. Background
Yonsei University will temporarily suspend in-person lectures and supplement them with online/non-face-to-face lectures until March 28, 2020 (and may be extended depending on conditions). Be advised that any copyrighted materials that lecturers incorporate into their online/non-face-to-face lectures, such as but not limited to PPT and videos, are the original author’s property and protected under the Copyright Act. Therefore, those who use copyrighted materials, in the way of exceeding permitted legal boundaries, may be in violation of the Copyright Act, and can be held liable under both civil and criminal law.
2. Notices
A. Permitted Acts
Those who receive education at an educational institution may reproduce or interactively transmit the works made public within the extent where deemed necessary for the purpose of education (Copyright Act Article 25 Clause 3)[1]. Therefore, during the online/non-face-to-face lecture period, it is permitted to copy and download lecture materials for the sole purpose of education.
B. Prohibited Acts
(1) The distribution (in the case of printed materials) or the transfer (file upload) of downloaded lecture materials to anyone.
(2) Measures that nullify (i) duplication preventing tools, or (ii) access restrictions, for other than enrolled students. For instance, prohibited activities include the sharing or informing of usernames and passwords for YSCEC onto which lesson materials are posted; or the defeating / alteration / circumvention of anti-duplication safeguards placed upon lesson materials.
(3) Uploading lecture materials on the Internet or sending them to others online can violate international Copyright law, potentially subjecting individuals to serious legal action. Do NOT share any lecture materials with others. Do NOT open any lecture materials to the public.
Copyright Act
Article 136 (Penalty Provisions)
(1) Any person who falls under any of the following subparagraphs may be punished by imprisonment with labor up to five years or by a fine up to 50 million won, or may be punished by both:
1. A person who infringes on author’s economic right or other property rights protected pursuant to this Act (excluding the rights under Article 93) by means of reproduction, performance, public transmission, exhibition, distribution, rental, or production of derivative works
